I have some hi bitrate files with MKV profile 5 and up they stutter on my Panasonic set, I am unable to transcode these files as Mezzmo says the tv can play the file

Is there anyway to force the files to be transcoded

Yes - you can force them to be transcoded using the Pre-transcode Files dialog and selecting the 'Pre-transcode files even if they match the devices supported formats' checkbox. See http://forum.conceiva.com/showthread.php/6025-Tutorial-Pre-transcoding-Files for more details.
